Girlguiding has refused to accept the Supreme Court gender ruling with boys being allowed to use female camp rooms and leaders not obliged to tell the parents, a whistleblower has claimed.

The Supreme Court unanimously ruled on April 16 that the terms “woman” and “sex” in the Equality Act 2010 refer to “a biological woman and biological sex”.


The charity, the UK’s largest girl-only youth organisation, has allegedly told volunteers that they should sideline the judgement.

Campaigner and psychotherapist James Esses shared the insider knowledge on X, branding the guidance as a “safeguarding nightmare”.

Baroness Arlene Foster said: “I’m sorry to say that Girlguiding has completely lost its core values of instilling self esteem and confidence in girls and has thrown those concepts away to be edgy and ‘modern’.

“As a former brownie, guide, young leader and guide leader, it makes me so sad.”

Baroness Jacqueline Foster said that the organisation “needs to comply with the law”, and barrister Daniel ShenSmith

For Women Scotland – the campaign group which challenged the Scottish legislation – responded to the claims. “This is why none of us can stop,” they said.

“But now that the law is behind us, organisations like @Girlguiding should be wary of continuing to put girls at risk.”

Earlier this week, Sir Keir Starmer broke his silence on the Supreme Court’s ruling, stating that a “woman is an adult female”.

“I actually welcome the judgment because I think it gives real clarity,” he told ITV.

“It allows those that have got to draw up guidance to be really clear about what that guidance should say.

“So I think it’s important that we see the judgment for what it is. It’s a welcome step forward.”

However, Starmer could face an internal struggle with senior Labour MPs about the implementation of the ruling.

Leaked messages from a WhatsApp group showed Labour MPs plotting to defy the Supreme Court’s ruling.

Culture Minister Sir Chris Bryant agreed with an MP criticising equality watchdog chief Baroness Falkner after she said the ruling meant trans women could not use women’s toilets or compete in women’s sports.

Home Office Minister Dame Angela Eagle added: “We need to organise.”

No10 confirmed Starmer will not take disciplinary action against the ministers, arguing that the cabal were not trying to undermine the ruling.

Responding to the ruling, LGBT charity Stonewall said: “Stonewall shares the deep concern at the widespread implications for today’s ruling from the Supreme Court. It will be incredibly worrying for the trans community and all of us who support them.”
