I'm a lawyer in Alberta, based in Alberta. And I have been asked by Iron Will of Strong and Free Canada to provide his viewers with regular updates concerning what is going on in the Canadian. We're presently during a time when many, many things are going on and happening. And we're going to talk about those in a moment. But before I do that, I just want to thank Will for providing me with the video equipment that is being used for to produce this update. It's also being used for the purposes of producing my own podcast called "Grey Matter", which I'd ask anyone to who's interested to check out we have - now more than 30 episodes posted, the following is growing very quickly. And we're grateful for that. Today, we're going to talk about specifically about some cases that my firm is handling in Canada, on the subject of Canadian workers. So recently, a number of large scale actions have been filed in the Federal Court of Canada and in also in the province of Manitoba, in British Columbia and in Alberta. All these actions have many aspects in common. These are actions that are brought on behalf of large groups of workers, there are literally 1,000s of them, who have been impacted by vaccine mandates that are being imposed primarily by the federal government, but that are also being acted out by corporations and by provincial governments, the position that's being taken on behalf of workers who are bringing legal action against these companies and also against governments is that fundamentally vaccine mandates constitute human rights violations, Canadian Charter of Rights and Freedoms violations and also violations of provincial human rights statutes. So who are these people? Who are the the workers who are bringing these lawsuits? Well, here's a list of the companies who are being sued. CN, CP, Purolator, Posties for freedom WestJet. Now in each case, they're not only the companies are being sued, but also the Government of Canada. And the reason for that is that in each case, the vaccine mandate stems from the Ministerial Order of the Minister of Transport. And also that goes right back to our Prime Minister, Prime Minister Trudeau, who put right in his letter of appointment to the Minister of Transport, that he wants to get every single worker in his ministry fully vaccinated. And of course, as we know, just recently, the federal government has changed the definition of fully vaccinated so that it has been vitiated, there's no such thing as fully vaccinated anymore. In fact, the clear message from the Canadian government is that not only Canadian workers, but every Canadian every man, woman and child is expected to submit to these dangerous vaccinations on a regular nine month rotation. So there's those companies now in Alberta, we bought actions against CRL, which is the second largest oil producer in Western Canada, and also against Atco, very large power company in Alberta, the largest actually, in British Columbia, we've sued the city of Canal, which is up near Prince George, in Manitoba, we've sued on behalf of a group of Manitoba health care workers, and also on behalf of some very brave workers, teachers at the University of Winnipeg. What are these actions have in common? In each case, what they claim is that the workers' human rights have been violated. These claims are mostly brought on behalf of unionized workers, which creates a problem strategically. And the reason why is that a unionized worker contracts out their employment rights to a union to a trade union under a contract called a collective bargaining agreement, and that collective bargaining agreement effectively prevents workers from suing an employer directly in order to enforce their employment rights. And so that instead, it requires workers to file what's called a grievance and have these grievances arbitrated so that they can't go directly to a court. Now, the employers and especially the governments' involved have foreseen this. And it's very clear that the unions are, if not complicit with management and government are at least or at best indifferent to the cause of their workers, because these grievances by and large are not being taken up, and so the worker is left with no remedy. In a situation where they refuse to take the vaccine, they refuse to submit to testing, for whatever reason, whether it's on a religious basis, a medical basis, or just because they know and they understand that they cannot be required to take any anything into their bodies without their informed consent. But in any case, these workers and as I say, there's 1000s of them across Canada, from all walks of life, they have been placed on involuntary unpaid leaves of absence. Each of these actions therefore claims that these involuntary unpaid leaves of absences constitute constructive wrongful dismissal in law. And even though some of these ministerial orders, for example, the Ministry of Transport order have been suspended. Some of these workers have been off work since last fall, they're several months out of work, they were denied eligibility for employment insurance benefits. And even though the employers are now inviting them back enmasse, they're not being, they're not being provided with any lieu pay for that whole time during which they were off work. So this is unconscionable. What we're doing is we're saying okay, these workers cannot sue the employer or the governornment of Canada directly to enforce their employment rights. However, their human rights and their Charter rights exist independently. And so each of these lawsuits seeks a declaration from the court. Firstly, that the vaccine mandates, the vaccine mandate policies and then these Ministerial orders violate their Human Rights, violate their Charter rights, specifically, life, liberty, security of the person, freedom of religion, section 15, freedom from arbitrary discrimination, unlawful discrimination, and it seeks that declaration. Now, this is important because these actions do not ask the court to set aside the ministerial order or to set aside the policy. It merely asked the court to declare on a legal and a factual basis, that those policies that those ministerial orders, in fact, violate human rights and violate Charter rights. We think that that will be a hurdle that is surmountable, because several courts across the country have effectively already found that COVID 19 restrictions do violate charter freedoms. And so once we get past that initial hurdle, then the next step is under Section 24(1) of the Charter, the workers are entitled to ask the court for a remedy. And under Section 24(1), the court can grant any remedy that would otherwise be available to court. And in this case, the remedy we're asking for is very simple. It's damages, aggravated damages, and punitive damages, damages arising from physical, emotional, psychological and financial harm, and also punitive damages. Because what we have here is in the nature of deliberate and really malicious human rights violations. Why do we say that? We said that because it's very clear that these vaccine mandates are an orchestrated, designed attack on the Canadian working class. vaccine mandates do not impact the poor. They do not impact street people. They do not impact certainly do not impact the political class. In fact, it's doubtful that many members of the political class have even taken the vaccines. Recently, you might have seen that the CEO of Pfizer was invited to accept an award in Israel, which is the equivalent of Israel's Nobel Peace Prize, the CEO of Pfizer had to receive a special exemption from the nation of Israel to enter the country. And he and he had to admit publicly, he's not fully vaccinated. Let me say that again. The CEO of Pfizer hasn't had the full set of jabs. So is it rational to expect that other members of that class have taken these jobs? I don't think so. The uber rich are not impacted by vaccine mandates. They're above all this. They fly around in private jets. You take our prime minister as an example, he flies around on a private jet. He does not. He's not required to comply with any quarantines or anything of that nature. He have announced this publicly that he has COVID-19 Even though he claims to have been vaccinated and boosted, he said COVID More than anyone I know. But so the point is the only people who seem to be impacted, that seem to be who are evidently impacted by vaccine mandates, are these Canadian workers, skilled Canadian workers. I call these people the best Canadians. They are the people working on trains and planes and ships everywhere in the economy delivering your mail, couriers, health care workers, they're everywhere, they are the people who make the country go. And historically, Canada has been a nation of working class, the working class has been highly successful in Canada, and therefore Canada has been a very free country, Canada is becoming less free, as the as the financial independence and viability of the working class is being eroded and destroyed by government, and by governments' weaponization of big corporations, such as CN, CP, and Purolator, which is 91% owned by the Canadian government. What's at stake here is the power brokers, the people who want to dis-entitle the working class, they want to create a society in which these people cannot hold their jobs, where they cannot afford to hold on to personal property or require personal property, and therefore they are not free. They become slave consumers. If you read Klaus Schwab's book "The Great Reset", it's all there. Look at UN 2030. It's all there. This is the process and this is what we're fighting for. It's very important for people watching this to understand that the plight of these workers is the plight of Canada, if Canada's not does not survive as a working class country, if the people are the kind of people who attended the the freedom convoy, the kind of people who are on their tractors, in places like Holland, and Italy, and Poland today, if these people are not, do not have the freedom, to live their lives, to work their farms, to go to their jobs, to pay their mortgages, to raise their families, to get out and teach school, and coach, hockey teams and dads troops and you name it. These are the glue people that are holding the free and democratic society of Canada together. Without their ability to work and earn income, we will not be a free and democratic society, we will be a society of consumer slaves that are ruled by an elite. And that's what's at stake here. That's why the vaccine mandates are still being pushed by this government when countries around the world have abandoned them. It's because Canada is a nation, which is ruled by ideologues who have, as an agenda the destruction of disentanglement of the working class. And the vaccine mandate has nothing to do with health, has nothing to do with safety, is everything to do with power, power, power. These actions have all been commenced several of them and there are in the Federal Court of Canada. And some of them are in the in the Alberta Court of Queen's Bench. And as I said two of them are in the Manitoba Court of Queen's Bench. And one of them is in British Columbia Supreme Court. What are the next stages? Well, all of these actions are in their early stages. What's interesting about the CN and the CP cases is which - those ones were filed much earlier on, is that in those cases, the Government of Canada, and the corporation's did not actually defend those lawsuits. Instead, what they did is they approached us with the proposal to have those cases go into what's called case management. And this is significant because what we now have is we have a situation where we have a judge who's appointed to guide the case through the litigation process. Case Management judges, not only do that, but they tend to work very hard to facilitate settlement. And so early on, it's not yet clear the approach that for example, the lawyers for CN and CP and the Government of Canada are going to take with respect to those actions. But at this point, they have not defended and we don't know whether they're going to do that. It may very well be that they're going to want to enter into serious discussions, settlement discussions and engage in those. But you know, time will tell. But I think what will happen ultimately with CN, CP, Purolator and the Canadian postal workers and WestJet is that they'll probably all be sort of grouped together and move through the courts together. That's what's anticipated. So the point here is that there is a momentous fight going on in the Canadian courts being brought by Canadian workers, and it's a very important fight, it's really I think, is essential to the cause of freedom in Canada. And it emphasizes the importance of speaking our rights, our individual human rights, our Charter rights into existence. Our governments and these large corporations are complicit in suppressing these and not only violating but in suppressing these rights, and trying to convince workers that they don't have rights that they should just submit. We have some great examples in Canada right now. We have the courage of people like Tamara Lich, whose case I'm going to profile on an upcoming episode of this Iron Will legal update. She was just yesterday denied bail by justice of the peace and one of the most heinous disgusting decisions I've ever read in my 30 years of legal practice. Fortunately, she has a bail review that's going to occur next week. And I'll be updating you on the circumstances of that. That's a bit of a teaser. And I'm also going to be providing an update on the Ingram case, the case involving Deena Hinshaw. Some of you may know that myself and Jeff Rath have been involved in fighting the Government of Alberta over COVID restrictions, lockdown restrictions, and that we cross examine doctor he Hinshaw for several days, a few months ago, that that case is ongoing. The government lawyers are about to file their brief in a few days. We're waiting to see that, and then we'll have a chance to respond. So in the next two episodes of these reports, I will be updating you on the status of those cases and others. I hope that this has been informative. I think it's very important, it's vital that the message get out to people that in fact, there are those of us who are out there fighting. More importantly, there are many, many 1,000s of brave Canadian workers who will not stand for this, who are sick and tired of the oppression of their governments and these large corporations that have no regard for the rights and freedoms that are complicit in these violations. And they've had enough and they're willing to fight, they've grouped together. And even though their resources are small, and they need the financial support of anyone who would give it they're extremely brave and very committed. And I believe that their fight is absolutely vital, absolutely crucial to the survival of Canada as a free and democratic nation. Thank you very much. And I hope that you all have a wonderful day. I have yet to see anyone take on social media for their censoring of constitutionally protected speech & punishing people for their constitutionally protected speech, as this may be seen as not as important, but the silencing of speech is how they bullshit the masses & it will only get worse as the WHO now wants to silence anyone questioning their narratives on social media.
I see it as two issues the first being the censorship of constitutionally protected speech & the right to say things publicly some may not want the public to hear because it was not approved by the ministry of propaganda.
the other is the punishing of people for their constitutionally protected speech in order to force them to modify their behavior & or publicly expressed beliefs or opinions which is psychological oppression that constitutes cruel & unusual punishment.
so even as a private platform they claim to have the right to moderate content, they do not have the right to punish people for constitutionally protected speech by banning people / repeat offenders or in any way limiting their reach.
one may say just go to another platform, the problem with that is they will not simply allow you to take your intellectual property & leave
as upon request they should have to give you your list of contact & subscribers with their associated Email addresses.
we are not going to win this war until we take down their propaganda machine & although the main stream media has done a great job at exposing their bias & pure fabrication of the official narrative, without a way for the public to challenge their propaganda the majority who are not awake will never know there is an alternative discussion or point of view.
so we really need to see some lawyers taking on Big Social Media
in the end we need to see them declared a public utility like the phone, electric & cable companies that have no business scrutinizing content, removing content (other than that which is either calling for violence against a person group or specific entity or encouraging someone to commit a crime)
and even in the rare case of approved removal of content, never having the ability to punish one for their speech, if they suspect something is illegal it should be submitted to law enforcement to deal with, never the corporation unless instructed by law enforcement.
the poor are impacted by the mandates as there ability to do basic commerce in many cities in provinces is being drastically restricted or being denied & the massive money printing schemes that favor the wealthy & the corporations leave the those on fixed incomes with unethical cost of living increases foisted upon them with far more severe impact in many cases than the working class.
so with the working class its more on the financial level of threatening ones income, with the poor the impact is of a lesser scope of denial or severe limits of access to basic essential services, services that much of the working class can avoid as they can afford to order meals & such delivered where that is a luxury the poor can not afford.
