President Donald Trump has called the Supreme Court ruling to strike down his tariffs implemented under the IEEPA a “disgrace” following the decision.  

Kaitlan Collins reported on X, “President Trump commented on the Supreme Court ruling striking down his tariffs while inside the White House breakfast with governors this morning, calling it a ‘disgrace,’ I’m told. He told those gathered that he has a backup plan.”

The comments from Trump came after a 6-3 decision at the Supreme Court that the IEEPA, or International Emergency Economic Powers Act, does not allow for the president to issue emergency tariffs. 

“IEEPA does not authorize the President to impose tariffs,” the ruling stated. “The judgment in No. 24-1287 is vacated, and the case is remanded with instructions to dismiss for lack of jurisdiction; the judgment in No. 25-250 is affirmed.”

The justices in the majority included Chief Justice John Roberts, Sonia Sotomayor, Elena Kagan, Neil Gorsuch, Amy Coney Barrett, and Ketanji Brown Jackson. Those who dissented included Justices Samuel Alito, Clarence Thomas, and Brett Kavanaugh. 

Kavanaugh, who wrote the main dissent, wrote, “I firmly disagree with the Court’s holding today, the decision might not substantially constrain a President’s ability to order tariffs going forward … because numerous other federal statutes authorize the President to impose tariffs and might justify most (if not all) of the tariffs at issue in this case.”

Kavanaugh also warned that “in the meantime, however, the interim effects of the Court’s decision could be substantial. The United States may be required to refund billions of dollars to importers who paid the IEEPA tariffs, even though some importers may have already passed on costs to consumers or others.”
